Terms & Conditions of Service and Privacy Policy
These terms govern access to and use of the kosmos.coop platform during its beta phase and the processing of data of the organizations and individuals who register. By ticking the acceptance box in the registration form, you confirm you have read and accepted them and grant the consents described below.
1. Service provider
The kosmos.coop service is owned by Opengea SCCL (hereinafter, "Opengea" or "the provider"), a cooperative with tax ID F70709969 and registered office in Barcelona (Catalonia). Contact: info@opengea.org. Data protection contact: info@opengea.org.
2. Object and description of the service
kosmos.coop is a cooperative digital ecosystem for the social, solidarity and regenerative economy that lets organizations create a profile, appear on the map, connect with other actors, publish and answer calls, take part in deliberative processes and formalize agreements. The core service is free; certain advanced (premium) features may be paid.
3. Beta phase
The service is currently provided in a beta phase. It may contain errors and be subject to changes, interruptions or data loss, and features may change or be withdrawn without notice. The service is provided "as is" and "as available", without warranties of any kind.
4. Registration, members and identifying organizations
Any organization may identify itself in the registration form by searching our database or entering its name. Member status in the kosmos.coop ecosystem is a specific qualification granted by Opengea; identifying yourself or requesting access does not automatically grant member status. Effective onboarding and, where applicable, member status require validation by Opengea. We reserve the right to accept or refuse requests based on alignment with the values of the social and solidarity economy.
Anyone registering declares they are of legal age and have sufficient capacity and authorization to act on behalf of the organization they identify.
5. Data we collect
- Data provided in the form: organization name (and, where applicable, its identifier in our database), town, contact person's name and email address.
- Technical data: IP address, user agent, date and time of the request and consent record.
- Data obtained from public sources and from the organization's website (see section 6).
6. Consent and purposes of processing
By accepting these terms, you expressly consent to Opengea:
- Registering and processing your data to manage the request, create and manage the organization's profile and enable participation in the ecosystem.
- Accessing and analysing (scanning) the organization's website and other public sources (open registries, public social networks, directories) to obtain relevant information and complete or enrich the organization's profile (activity, sector, location, public contact details, logo and description, among others).
- Sending you service-related communications (registration management, beta news and ecosystem information). You may object at any time.
No automated decisions with significant legal effects will be made without prior information. No special categories of data are processed.
7. Legal basis
Processing is based on your consent (Art. 6.1.a GDPR), the performance of pre-contractual measures and of the requested service (Art. 6.1.b) and Opengea's legitimate interest in maintaining and improving the ecosystem and completing profiles from public information (Art. 6.1.f), always balanced against your rights.
8. Data retention
We keep the data for as long as the relationship with the ecosystem lasts and, once ended, for the applicable legal periods to handle liabilities. You may request erasure at any time.
9. Data sharing
The organization's profile data may be publicly visible within the ecosystem and the map. We do not sell your data to third parties. We may use technology providers (hosting, email) acting as data processors under appropriate safeguards. No international transfers outside the European Economic Area are envisaged; if any occurred, GDPR safeguards would apply.
10. Your rights
You may exercise your rights of access, rectification, erasure, objection, restriction and portability, and withdraw consent at any time (without retroactive effect), by writing to info@opengea.org. You also have the right to lodge a complaint with the Catalan Data Protection Authority (APDCAT) or the Spanish Data Protection Agency (AEPD).
11. Security
Opengea applies reasonable technical and organizational measures to protect data. No system is infallible; in the event of a security incident affecting you, we will act in accordance with applicable law.
12. Acceptable use
You agree to use the service lawfully, to provide truthful information and not to engage in conduct that may harm the service, third parties or the ecosystem. Opengea may suspend or cancel access in the event of a breach.
13. Intellectual property
The platform, software and distinctive signs of kosmos.coop belong to Opengea or its licensors. Content you provide remains yours; you grant us a non-exclusive licence to display and process it within the ecosystem for the purpose of providing the service.
14. Liability
To the extent permitted by law, Opengea shall not be liable for indirect damages or data loss arising from use of the service in its beta phase. Nothing herein limits liabilities that cannot be excluded by law.
15. Changes
We may update these terms. We will publish the current version on this page with the update date. Continued use of the service implies acceptance of the current version.
16. Governing law and jurisdiction
These terms are governed by Spanish and Catalan law. For any dispute, the parties submit to the courts of Barcelona, unless consumer regulations establish a different forum.
